Canada - Constitutional challengeOn 6 June 2003 the Supreme Court of Canada heard an application by the Canadian Foundation for Children, Youth and the Law to strike down section 43 of the Canadian Criminal Code.  This is the Canadian defence to 'corrective' assault that was first codified in 1892; similar to our Crimes Act, Section 59.  The Supreme Court has reserved its decision and the result of this challenge to the Constitution is expected between October and December this year.
